L'EMBARCADERE SAS, operating under the trade name HOTEL L'EMBARCADERE, is a company registered in the Trade and Companies Register under number RCS 981 833 742 RCS BOURG EN BRESSE, whose registered office is located at 13 avenue du Lac 01130 Nantua, France, and whose intra-community VAT number is FR14981833742
These General Terms and Conditions of Sale apply to all reservations made with HOTEL L'EMBARCADERE, regardless of the channel used, including the website, telephone, email, or directly at the establishment's reception desk.
1. Preamble
1. The customer, prior to ordering services, declares that the reservation of these services is made for his or her personal needs.
2. As a consumer, the customer has specific rights, which would be called into question if the reserved services are for purposes that fall within the scope of his or her commercial, industrial, craft, liberal, or agricultural activity.
3. All information accessible on the Website and Mobile Services, allowing the reservation of services, is presented in French as well as in several other foreign languages.
4. The customer declares that he or she has full legal capacity to commit to these general terms and conditions.
5. The customer's agreement regarding the general terms and conditions of sale of HOTEL L'EMBARCADERE and the terms and conditions of sale of the reserved rate is made at the time of reservation; no reservation is possible without this agreement.
6. The customer has the option to save and edit these general conditions using the standard features of their browser or computer.
HOTEL L'EMBARCADERE publishes and operates the website https://www.hotelembarcadere.com/, a hotel reservation site.
Services
1. The Website allows the reservation of rooms in its establishment.
2. The customer declares having obtained from HOTEL L'EMBARCADERE all the necessary information on the Website.
3. Any reservation via the Website implies consultation and full and unreserved acceptance of these general conditions and the conditions of sale of the reserved rate.
4. The Site and Mobile Services include the following information:
The legal notice allowing precise identification of the establishment, and indicating its company name, the address where it is established, its email address, its telephone number, its head office, and its individual identification number for VAT liability.
The essential characteristics of the accommodations offered.
The additional services offered.
The prices; The payment methods; and the accepted payment methods.
The general conditions of sale and the conditions of sale of the reserved rate;
The validity period of the offer and its price;
2. Purpose
These general conditions define the rights and obligations of the parties in the context of the remote reservation of services offered by HOTEL L'EMBARCADERE on its Website. They govern all the steps necessary for booking and monitoring the reservation between the contracting parties.
The customer acknowledges having read and accepted these general terms and conditions of sale and the terms and conditions of sale for the reserved rate, which are accessible on the Site. These general terms and conditions also include the Customer Charter for the protection of personal data. By accepting these general terms and conditions, the customer expressly accepts the provisions of this Charter.
3. Scope and duration
These general terms and conditions of sale apply to all reservations made online, via the HOTEL L'EMBARCADERE website, by telephone, by email, or directly at the establishment's reception desk. These general terms and conditions of sale apply for the entire duration that the services are online on the Site. HOTEL L'EMBARCADERE reserves the right, without prior notice, to temporarily or permanently close access to reservations, whether online, in person, or by email. In any event, the version of the general terms and conditions of sale applicable to the customer is the one in effect at the time of the reservation.
4. Reservation
1. The customer chooses the services presented on the Website or directly by email, telephone, or at reception.
2. The customer acknowledges having read the nature, destination, and reservation terms of the available services and having requested and obtained the necessary and/or additional information to make their reservation with full knowledge of the facts.
3. The customer may reserve, individually and for their personal needs, a maximum of ten (10) rooms per reservation. For reservations for business groups, meetings, seminars, etc., it is necessary to contact the establishment directly at the following email address: contact@hotelembarcadere.com
4. The customer is solely responsible for their choice of services and their suitability for their needs, such that HOTEL L'EMBARCADERE cannot be held liable in this regard.
5. The reservation is deemed accepted by the customer at the end of the reservation process.
5. Reservation Process
Reservations made by the customer are made via a digital reservation voucher sent by email. The reservation is deemed to be made upon receipt of the reservation confirmation or upon prepayment by credit card.
The customer undertakes, prior to any reservation, to complete the information requested on the reservation request. The customer attests to the truthfulness and accuracy of the information provided.
The reservation procedure includes the following steps:
Step 1: search for a hotel and choice of room and rate;
Step 2: selection, if applicable, of one or more additional services
Step 3: verification of the reservation details, its total price, the applicable sales conditions and any adjustments to the choice (room, rate, additional service), in the case of online reservations only;
Step 4: entry of the customer's contact details;
Step 5: entry of the bank card in the event of a guarantee or prepayment request
Step 6: consultation and acceptance of the general terms and conditions of sale and the terms and conditions of sale of the reserved rate before confirming the reservation;
Step 7: validation of the reservation by the customer.
6. Acknowledgment of Reservation
The Website acknowledges receipt of the customer's reservation by promptly sending an email to the customer at the email address previously provided. In the case of online reservations, the acknowledgment of receipt of the reservation by email summarizes the contract offer, the reserved services, the prices, the sales conditions relating to the selected rate, accepted by the customer, the cancellation conditions, the date of the reservation made, information relating to after-sales service, as well as the address of the seller's establishment to which the customer can submit complaints.

8. Cancellation or modification by the customer
The customer is reminded, in accordance with Article L. 221-28 of the French Consumer Code, that they do not have the right of withdrawal provided for in Article L. 221-18 of the French Consumer Code. The terms of sale for the reserved rate specify the terms for canceling and/or modifying the reservation.
Reservations with prepayment cannot be modified and/or canceled. Any amounts paid in advance, such as deposits, will not be refunded. In this case, it is mentioned in the sales conditions of the rate.
When the sales conditions of the reserved rate allow it:
Cancellation or modification of the reservation can be made directly on the Website;
Otherwise, modification or cancellation of the reservation can be made directly with the hotel, whose telephone numbers are specified on the reservation confirmation sent by email.
In the event of interruption of the stay due to the customer, the full agreed price will be charged. In the case of a reservation with prepayment, no refund will be granted.
Unless expressly stated otherwise, the customer must vacate the room before 11:00 a.m. on the day the reservation ends. Otherwise, they will be charged for an additional night.
All reservations are personal and may not be transferred to a third party, whether free of charge, for a fee, or for commercial purposes.
9. Hotel Stay
In accordance with current regulations in France, the guest may be asked to complete a police form upon arrival at the hotel. To do this, the guest will be asked to provide proof of identity in order to verify whether or not they must complete the police form.
Upon arrival at the hotel, a security deposit will be temporarily blocked on your bank card. This amount will not be debited but will serve as a guarantee to cover any additional costs or damages. This bank imprint will be released after your departure, subject to verification of the condition of the room and the absence of unpaid charges. The refund time depends on your bank.
Pets: Pets are welcome in our establishment.
To guarantee the comfort and hygiene of all our guests, we thank you for ensuring that they are kept on a leash in common areas and for respecting the cleanliness of the premises.
Assistance dogs accompanying people with disabilities are of course permitted, in accordance with current legislation. We invite you to inform us in advance of their presence in order to best prepare their reception.
The guest accepts and agrees to use the room with due care. Also, any behavior contrary to good morals and public order will lead the hotelier to ask the guest to leave the establishment without any compensation and/or without any refund if a payment has already been made. If no payment has yet been made, the guest must pay the price of the nights consumed before leaving the establishment.
HOTEL L'EMBARCADERE has Internal Regulations for the guest. The guest accepts and agrees to respect these regulations. In the event of non-compliance by the guest with any of the provisions of the Internal Regulations, the hotelier will be obliged to ask the guest to leave the establishment without any compensation and/or without any refund if payment has already been made.
The guest agrees to respect the hotel rules:
Smoking is strictly prohibited in areas designated as non-smoking. Smoking areas are located outside the hotel, where ashtrays are available, as well as on the outdoor terraces. Any failure to comply with this rule will result in a fine of €250.
Any damage or loss caused by the guest will be charged.
Free Wi-Fi access is available to guests. The guest undertakes that the IT resources made available by the hotel will not be used in any way for the reproduction, representation, provision, or communication to the public of works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software, and video games, without the authorization of the rights holders provided for in Books I and II of the Intellectual Property Code, when such authorization is required. If the guest fails to comply with the aforementioned obligations, they risk being charged with the offense of counterfeiting (Article L.335-3 of the Intellectual Property Code), punishable by a fine of €300,000 and three years' imprisonment. The customer is also required to comply with the security policy of the hotel's internet service provider, including the rules for using the security measures implemented to prevent the illicit use of IT resources and to refrain from any act that could undermine the effectiveness of these measures.
10. Responsibility
The photographs presented on the Website or those of partners are for informational purposes only. Even though every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the hotel presented give as accurate an overview as possible of the accommodation services offered, variations may occur, in particular due to changes in furniture or possible renovations.
Hypertext links may lead to sites other than the hotel's website, which disclaims all responsibility for the content of these sites and the services offered.
Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the customer will result in the cancellation of the order at the customer's expense, without prejudice to any civil or criminal action against the latter.
HOTEL L'EMBARCADERE cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, due to a third party, unforeseeable and insurmountable, due to the customer, in particular unavailability of the internet network, inability to access the website, external intrusion, computer viruses or in the event of prepayment not authorized by the cardholder's bank.
HOTEL L'EMBARCADERE declines all responsibility in the event of:
Theft or loss of objects in the rooms or common areas.
Damage caused by external events (force majeure).
11. Complaints
Complaints relating to the non-performance or poor performance of hotel services must, to facilitate their processing, be brought to the attention of HOTEL L'EMBARCADERE in writing within eight days of the hotel's departure date, directly to the hotel or to the Customer Service contact details indicated above.
12. Prices
Prices relating to the reservation of services are indicated before and at the time of booking. The prices indicated are per room for the number of people and the date selected. Prices are confirmed to the customer in the amount inclusive of VAT, in the hotel's commercial currency and are only valid for the duration indicated on the Website. All reservations, regardless of their origin, are payable in the hotel's local currency, unless special arrangements are indicated on site. If the debit at the hotel is made in a currency other than that confirmed on the reservation, the exchange fees are the responsibility of the customer.
Unless otherwise stated on the Site, additional services (breakfast, various drinks, etc.) are not included in the price unless otherwise stated on the reservation confirmation.
The tourist tax, shown on the rates page, is to be paid directly on site to the hotel except in the case of online prepayment where this amount may be included.
Prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the prices indicated on the invoice date.
Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will be automatically reflected in the prices indicated on the invoice date.
If the debit at the hotel is made in a currency other than that confirmed on the reservation, the exchange fees are the responsibility of the customer. If a rate requires payment to be made at the hotel upon arrival or departure of your stay, and the customer's currency is not the same as that of the hotel, the rate charged by the hotel may be different from that communicated at the time of reservation, taking into account the possible evolution of exchange rates between the reservation date and the dates of stay at the hotel.
HOTEL L'EMBARCADERE will indicate the total amount of the order when confirming the customer's reservation. Rates may be increased by various municipal taxes. The Customer agrees to pay the various taxes, without any dispute to the establishment.
Certain promotional offers available on the internet are sold exclusively on the internet, i.e. only remotely and under no circumstances at the hotel reception.
13. Payment
1. For all reservations, whether online, by telephone, by email, or directly at reception, the customer provides their bank details as a guarantee of the reservation, except for special conditions or rates, by credit or private bank card (Visa, Mastercard) by directly indicating, in the area provided for this purpose (secure entry by SSL encryption), the card number, without spaces between the numbers, as well as its expiry date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram in the case of a prepayment via the secure.reservit.com payment platform. The customer must present the bank card used to guarantee the reservation or make the prepayment. The hotel may also ask the customer to present an identity document for the purpose of preventing credit card fraud.
2. Payment is debited at the hotel during the stay, except in the case of special conditions or rates where payment is debited at the time of booking (online prepayment for certain rates). This prepayment is referred to as a deposit. In the case of a rate not prepaid online, the hotel may ask the customer, upon arrival, for a security deposit or authorization to debit the credit card, in order to guarantee payment of the amounts corresponding to the services consumed on site.
3. In the event of a no-show (reservation not canceled - customer not present) of a reservation guaranteed by credit card, the hotel will debit the customer, as a fixed compensation, the amount of the first night on the credit card that was given as a reservation guarantee and any additional nights of the reservation will be canceled free of charge unless otherwise indicated in the conditions of sale of the reserved rate.
4. HOTEL L'EMBARCADERE has chosen secure.reservit.com to secure online payments by credit card. The validity of the customer's payment card is verified by secure.reservit.com. A payment card may be refused for several reasons: stolen card, blocked card, limit reached, data entry error, etc. In the event of a problem, the customer must contact their bank on the one hand, and the hotel on the other to confirm their reservation and payment method.
5. If the customer reserves several rooms but the prepayment is only necessary for one room, for example, in this case, the payment card used on the payment platform is used to pay for the room concerned by the prepayment and the payment card entered will serve as a guarantee for the other rooms.
6. At the time of prepayment, the amount debited at the time of booking includes: the price of accommodation, taxes related to accommodation, the price of catering if breakfast is chosen, and any other additional services selected by the customer.
7. In the case of a rate subject to online prepayment, the amount paid in advance, which is the deposit, is debited at the time of booking.
8. Some hotels can generate invoices/notes electronically; the original file is certified and available directly from the establishment.
9. Our online reservation system is compliant with PCI-DSS (Payment Card Industry Data Security Standard). This compliance ensures that all payment data processed on our platform meets international banking transaction security requirements.
The security measures implemented include:
End-to-end SSL/TLS encryption during data transmission.
No retention of complete bank card data beyond the time strictly necessary for the transaction.
Regular audits, vulnerability testing, and proactive security risk management.
Transactions are managed through authorized and PCI-DSS certified payment providers.
14. Conservation - Archiving
HOTEL L'EMBARCADERE ensures the conservation of the written document confirming the conclusion of the contract for an amount greater than or equal to one hundred and twenty (120) euros from the conclusion of the contract until the performance of the service for a period of ten (10) years, and guarantees access to it at any time during this same period. Contractual documents will be kept in electronic or paper format.
15. Telephone canvassing
In accordance with Article L.223-2 of the French Consumer Code, you are informed of your right to register free of charge on the Bloctel telephone canvassing opt-out list (www.bloctel.gouv.fr).
16. Respect for privacy and personal data
1. HOTEL L'EMBARCADERE implements personal data processing, for which it is responsible.
2. The customer is informed, on each of the personal data collection forms, whether the responses are mandatory or optional by the presence of an asterisk.
3. If information identified as mandatory is not provided, HOTEL L'EMBARCADERE may not be able to register a reservation or manage the customer's complaints.
4. The information processed is intended for HOTEL L'EMBARCADERE, its entities, its partners, and its service providers (and in particular online payment providers).
5. The customer may authorize HOTEL L'EMBARCADERE to communicate their personal data to third parties in compliance with the Customer Charter for the Protection of Personal Data. Particularly when paying online, the customer's bank details must be transmitted by the payment service provider secure.reservit.com to the hotel's bank for the execution of the hotel reservation contract. The customer is informed that this data transfer may therefore take place in foreign countries that do not have adequate personal data protection within the meaning of the Data Protection Act. However, the customer consents to this transfer, which is necessary for the execution of their reservation. secure.reservit.com, in their professional capacity, have undertaken to HOTEL L'EMBARCADERE to take all security measures and respect data confidentiality for said data transfers.
6. The customer has the right to object for legitimate reasons, and the right to query, access, and rectify their personal data by writing to contact@hotelembarcadere.com. HOTEL L'EMBARCADERE may, in particular, send its customers its newsletter, promotional offers, and a satisfaction questionnaire following their hotel stay by email, providing the customer with an unsubscribe link at the bottom of each commercial prospecting email.

17. Proof agreement
The entry of the required banking information, as well as the acceptance of these general terms and conditions, the conditions of sale for the reserved rate and the reservation confirmation, as well as any special conditions, by electronic means, has the same value between the parties as a handwritten signature on paper.
18. Relocation
In the event of an exceptional event or the impossibility of making the reserved room available to the customer, or in the event of force majeure, the chosen hotel reserves the right to accommodate the customer in whole or in part in a hotel of an equivalent category, for services of the same nature and subject to the prior agreement of the Customer. Any additional cost of the room and/or transport between the two hotels shall be borne by the chosen hotel.
19. Force Majeure
1. Force majeure means any event external to the parties that is unforeseeable, insurmountable, and external to the parties and prevents either the customer or the hotelier from fulfilling all or part of the obligations set out in the contract. Cases of force majeure or fortuitous events are those usually recognized by the case law of the French Courts and Tribunals.
2. Neither party shall be liable to the other party for failure to perform its obligations resulting from force majeure. It is expressly agreed that force majeure suspends the performance of the parties' reciprocal obligations and that each party shall bear the cost of any resulting costs.
20. Dispute Resolution
1. HOTEL L'EMBARCADERE informs the customer of the possibility of resorting, in the event of a dispute relating to these general terms and conditions, to a conventional mediation procedure or any other alternative dispute resolution method, under the conditions set out in Title I of Book VI of the Consumer Code.
Mediation in the event of a dispute. After contacting customer service or the hotel management to attempt to resolve the dispute amicably, and in the event of a negative response or no response within sixty (60) days of the referral, the customer may contact the Tourism and Travel Mediator. Information concerning the Mediator (contact details and referral procedures) is available upon request from the hotel or by consulting the official website of the Tourism and Travel Mediator (www.mtv.travel). Referral to the Mediator may be made within twelve (12) months of the date of the first written complaint.
21. Applicable law
The general terms and conditions of sale of HOTEL L'EMBARCADERE are governed by French law without prejudice to any mandatory protective provisions that may be applicable in the consumer's country of residence.
22. Entirety
These general terms and conditions of sale for HOTEL L'EMBARCADERE, the terms and conditions of sale for the rate reserved by the customer, and the reservation voucher or request express the entirety of the parties' obligations. No general or specific conditions communicated by the customer may be incorporated into these general terms and conditions.
The documents forming the contractual commitments between the parties are, in descending order of priority, the reservation confirmation (including the specific conditions of the reserved rate) and these general terms and conditions. In the event of a contradiction between the reservation confirmation and the general terms and conditions, the provisions appearing on the reservation voucher will be the only ones applicable to the obligation in question.
23. Nullity
1. If one or more provisions of the general terms and conditions of sale of HOTEL L'EMBARCADERE are held to be invalid or declared as such pursuant to a law, regulation or following a decision that has become res judicata by a competent court, the other provisions shall retain their full force and scope.
24. Language
The authoritative language is French. If the general terms and conditions of sale of HOTEL L'EMBARCADERE are translated into a foreign language, the French language shall prevail over any other translation in the event of a dispute, litigation, difficulty in interpreting or executing these conditions and, more generally, concerning the relations existing between the parties.
25. Changes/Modifications to the Terms and Conditions of Online Sales
These general terms and conditions of online sales may be modified and/or supplemented at any time by HOTEL L'EMBARCADERE. In this case, the new version of the general terms and conditions of online sales will be posted online by HOTEL L'EMBARCADERE. As soon as it is posted online, the new version of the general terms and conditions of online sales will automatically apply to all customers, except for reservations made prior to the date of posting online, for which the previously accepted version of the general terms and conditions of sale remains applicable.
The customer must also consult the additional terms and conditions of sale relating to each rate, type of room or type of service, appearing on the price list.
